Xplora Senior T&C

 

These terms and conditions (the Agreement) apply between you as a user of the Xplora Senior service (“the User” or “the Senior”) and Xplora Technologies AS, company registration number 916 752 628 registered at Kongens gate 31, 0153 Oslo, Norway (“Xplora”).

Xplora Senior is a service made available on selected Doro/Emporia/Xplora phones and connected with the Xplora app or another Xplora companion app designated by Xplora (the Service). Any hardware warranty, device support or device-specific terms remain separate.

 

1. Users and acceptance

The Service is intended for the person using Xplora Senior (the Senior) and one or more connected family members, relatives, friends or other trusted persons using the Xplora app or another designated companion app (each a ”Guardian”).

By activating or using the Service, you confirm that you are at least 18 years old and legally able to accept this Agreement, or that you are authorised to do so on behalf of the Senior. A Guardian who sets up or manages the Service for a Senior confirms that the Guardian has the Senior’s authority or other lawful basis to do so.

 

2. The Service

The Service is designed to support communication, safety and remote assistance between the Senior and connected Guardians. Depending on device compatibility, permissions, app version, connectivity and territory, the Service may include features such as shortcut calling, device status, location sharing, safety zones, live tracking, scam protection, remote screen access, remote controls, contact management, step analytics and wellness notifications.

Some features may only be available through the Xplora Senior app. Certain features may be provided by or rely on third parties.

 

3. Important limitations

The Service depends on compatible devices, battery power, network coverage, Internet access, location services, granted permissions and correct setup. Xplora does not guarantee that the Service will always be available, uninterrupted, secure, accurate or error-free. Location, route, device status, alerts and similar information may be delayed, incomplete or inaccurate. Scam protection is a supplementary feature only and may not identify, block or prevent all unwanted, harmful or fraudulent communications. Remote assistance and remote screen access may not work in all situations and should only be enabled for trusted Guardians.

The Service is not an emergency response, healthcare, medical monitoring, social care or life-saving service and does not replace emergency services. In an emergency, the user must contact local emergency services directly.

 

4. Activation, use and privacy

To use the Service, the Senior must have a supported device with the Xplora Senior app, and the Guardian must use the Xplora app or another designated companion app. Users must provide accurate information, keep it reasonably updated, use the Service lawfully, and keep devices, login details, PINs and passwords secure.

To provide the Service, Xplora needs to process personal data such as account details, device information, alerts, contact information where access is granted, activity data where enabled, and location-related data where those features are used. Information about the Senior will be shared with connected Guardians to the extent required for the Service to function. Xplora processes personal data in accordance with applicable data protection laws and the Xplora Privacy Policy available at Xplora Privacy Policy.

 

5. Charges, changes and termination

These terms regulate the use of the Xplora Senior Service only. They do not regulate subscriptions, billing, purchases or payment for paid services or premium features, which are handled separately through the Xplora app or another designated Xplora purchase flow and may be subject to separate terms. Normal charges from the user’s mobile operator or Internet provider may still apply, including charges for calls, SMS, data usage and roaming.

Xplora may suspend, restrict or terminate the Service, in whole or in part, if reasonably necessary for security, legal compliance, technical reasons, fraud prevention, misuse, or breach of this Agreement. The Senior may stop using the Service at any time and may disconnect Guardians or deactivate the Service through available settings or support channels. Xplora may update the Service or this Agreement from time to time and will provide reasonable notice of material changes.

 

6. Liability and general terms

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. Xplora is not liable for losses caused by matters outside Xplora’s reasonable control, including network failures, loss of connectivity, device malfunction, operating system limitations, third-party service interruptions, inaccurate GPS or map data, or failure by the User to keep the device charged, connected, updated and correctly configured. To the extent permitted by law, Xplora is not liable for indirect, incidental or consequential losses. Nothing in this Agreement limits or excludes any rights or remedies that the User has under mandatory consumer law, or any liability that cannot lawfully be limited or excluded.

Xplora and its licensors own all intellectual property rights in the Service and related materials. Xplora grants the User a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose in accordance with this Agreement. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force. Xplora’s failure to enforce any provision is not a waiver of that provision.

 

7. Complaints and contact details

Questions, support requests and complaints regarding the Service may be sent to Xplora using the contact details below. Nothing in this Agreement limits the User’s right to bring a complaint before a competent consumer authority, court or dispute body under mandatory law. This Agreement is governed by the mandatory laws applicable in the territory where the Service is offered to the User.
